GILL Technologies Calls on the CRTC to Regulate Telecom Fraud

Peterborough, ON, Canada – September 21, 2009: Sophisticated attacks on voice mail and other telecommunications systems often leave consumers owing thousands of dollars in unwanted charges. According to GILL Technologies (http://www.gill-technologies.com) president George Gill, the CRTC must protect consumers instead of allowing carriers to inflict fraud-generated fees on victims.

In a letter dated September 21, 2009, the Peterborough, Ontario based telecommunications company’s head asked the CRTC’s Executive Director for Telecommunications to investigate the issue and develop new regulations.

Under the current system, responsibility for fraudulent use usually lies with the end user. On January 2009, Burlington, ON law firm Martin and Hillyer suffered a $207,000 bill from Bell due to voice mail hacking from abroad (“Bell Canada customer billed $207,000 after hacker breach,” The Canadian Press, January 27, 2009). In August, boutique telecom wholesaler Telepath incurred over $100,000 in charges from Rogers over a similar attack (“Hackers leave Ottawa company with sky-high phone bill,” Sarah Schmidt, Canwest News Service, August 17, 2009). In both cases, their carriers demanded to be paid despite the illegal, invasive cause of these bills.

In his letter to the Commission, Mr. Gill notes the following: “Beyond basic, user-centric precautions such as strong passwords, responsibility for secure telecommunications obviously rests with carriers. Under the current regime, carriers suffer a conflict of interest where preventing fraud denies them charges to levy against end users. In other words, the CRTC’s failure to regulate in this area rewards carriers for inadequate security. Currently, there’s no difference between a dollar earned on third party fraud and one earned through legitimate services.

“The current system doesn’t work. Informal resolution mechanisms waste time and money. In many cases, they don’t adequately protect end users. Therefore, I call on the CRTC to:

“1.    Regulate carrier security practices, as carriers currently have no economic motive to implement best practices.

“2.    Establish reasonable limits on end user and reseller liabilities for fraudulent charges.

“3.    Implement a dispute resolution system that investigates and fairly distributes fraudulent charges based on each party’s actual responsibilities.”

Steady decline in fixed telephony channels due to fixed-to-mobile substitution

Stuttgart (Germany) — According to the latest release of one InfoCom’s popular Monitoring Services — Fixed Line Telephony, on average, the fixed telephony penetration in Western Europe remained virtually unchanged at 55% (3Q08, YoY). In markets such as France, Germany and Italy, the expansion of VoIP was able to offset the decrease in traditional fixed line connections, resulting in a slight increase of the number of total channels. However, for other markets, the even significant uptake of VoIP services was not enough to offset the decline of fixed line connections. For instance, in the Netherlands and Denmark, which had already a significant VoIP share of 32.5% and 15.0% of the total telephony channels, the fixed telephony channels are decreasing of 1.4% and 6.6% respectively. For the majority of markets in Western Europe, the continuous decline in fixed telephony channels is still attributed to the strong fixed-to-mobile substitution effect as VoIP services have a relatively small impact yet.

In Eastern Europe, the total number of fixed telephony channels slightly increased by less than 1%. Stagnation in the fixed telephony market could largely be attributed to the fixed-to-mobile substitution effect and the limited access competition in the fixed market segment. Among the markets monitored, Slovenia experienced the largest decrease in fixed telephony channels with about 10% followed by Hungary and Czech Republic with about 4% decrease. The introduction of VoIP in the market was not enough to offset the stagnating fixed line market in the countries monitored. To date, incumbents still largely dominate the fixed telephony sector in their respective home markets despite market liberalisation. In all countries monitored — with only a couple of exceptions — the incumbent market share ranges between 70% and virtually 100%.

FCC Looking to Quell Growing Black Market Within Toll Free Industry

Washington,DC – In recent years, the limited availability of new numbers has created an intense and competitive demand for valuable 800, 888, 877 and 866 area code numbers. Following the emergence of a black market for these numbers, sources say federal authorities are cracking down on illegal toll free practices, including reports of attempts to sell or lease numbers off eBay.

The FCC does not play a role in the assignment of numbers to subscribers, however they do regulate the guidelines under which 1-800 numbers can be used and obtained. The hoarding and warehousing of numbers is prohibited and punishable with severe fines—recently illustrated by a citation for an $11,000 fine each day a California company continued to implement improper toll free practices.

IPTV is inching its way through pay-TV markets, becoming increasingly popular — But not everyone is successful

Stuttgart, Germany — According to InfoCom’s most recent release of its QUARTERLY TELEVISION MONITORING SERVICE, IPTV has been making its way through the pay-TV market with an increasing popularity in countries that generally have a large broadband subscriber base.

While some operators achieved six to seven-figure IPTV subscriber numbers, others were not as successful. In the UK, for instance, despite having significant number of broadband users, take-up of IPTV has been sluggish due to satellite and Freeview’s strong market hold that places the IPTV players at a disadvantage. Tiscali, in particular, has plateaued between 36 000 to 45 000 IPTV subscriptions from 2005 until 1H08. In Germany, Hansenet has been struggling to add subscribers since its IPTV launch in 2006. Telecom Italia and Spain’s Jazztel were also among these providers, which, despite their early IPTV commercialisation, have lagged behind in the IPTV race.

On the other hand, in the forefront of the IPTV race is the French incumbent, France Telecom, attracting more than 1.5m IPTV customers in 1H08 — more than 90% of which are from its domestic market and the rest, from subsidiaries in Spain and Poland. The French incumbent has also IPTV operations in Slovakia and Senegal but so far, numbers are rather negligible and do not significantly contribute to the total base. France Telecom kept its top position from end-2007 to 1H08 and largest IPTV provider.

MII China (comprising of China Telecom and China Netcom), in the 6-month period (end-2007 to 1H08), more than doubled its IPTV subscriber base — the highest increase among all groups. It superseded Verizon Communications in its top 2 position and at the same time, outranked PCCW and Vivendi (formerly Neuf Cegetel), at 3rd and 4th positions, respectively. The Beijing Olympics are likely to have played a significant role in the accelerated growth of IPTV subscriptions in this region.
