Houssiere, Durant & Houssiere, LLP filed the first MiniMed lawsuit against Medtronic, Inc., Medtronic MiniMed, Inc. and Medtronic Puerto Rico Operations Company, Nov. 30, 2009, on behalf of six patients who claim they have suffered severe injuries as a result of using a defective MiniMed insulin pump. With an estimated 60,000 defective insulin pumps on the market, thousands of patients may be at risk.

Medtronic Paradigm Quick-set Infusion Sets
“MiniMed lawsuits are product liability lawsuits where the product itself is on trial,” said Charles R. Houssiere III of Houssiere, Durant & Houssiere, LLP. “Trusting customers of Medtronic may have sustained injuries and damages because of their body’s possible reaction to the lack of insulin or the excessive insulin infused through the Quickset infusion device.”

MiniMed Insulin Pumps are designed to provide to Diabetic patients the correct amount of insulin their bodies need to survive. However, a potential defect in some of the Quick-set® Infusion sets that are used in conjunction with the MiniMed Paradigm insulin pumps may deliver an incorrect dose of insulin to Diabetic patients, which may result in severe injuries and death.

“As trial lawyers, we represent the injured and their families. We hope to inform victims of product defects of what they can do to be compensated for injuries caused by those products,” said Houssiere. “We intend to learn what Medtronic knew and when they knew it in regard to any possible defect in the insulin pump system.”

Medtronic, Inc. issued a Class I recall of their Quick-Set® Insulin Infusion sets, July 10, 2009. The company estimated that roughly 60,000 out of 3 million infusion sets could be affected. The recall explained a manufacturing defect of the tubing used in the Quick-Set® Infusion sets, referred to as “Lot 8,” which may prevent the pumps from properly venting air. The defect could potentially cause patients to receive too little or too much insulin, which could ultimately result in injury and death.

“We believe it is our responsibility, as trial lawyers representing people and families, to bring possible defects to the public,” says Houssiere. “We need to do as much as we can to inform the public if we learn there is something wrong with this device.”

He says potential injuries can include confusion, fainting, dizziness, difficulty speaking, sweating, seizures, coma and death.

This is the first lawsuit to be filed against MiniMed, Inc. regarding the insulin pumps. The multi-plaintiff lawsuit (case number 4:09-cv-03854) was filed with the United States District Court, Southern District of Texas, Houston Division Nov. 30, 2009.

Latest research by UK’s only organisation to offer nationally accredited qualifications in will writing and probate practice has brought to light the need for consumers to further check the abilities of the person dealing with their will, as 67% believe all willwriters are actually trained solicitors which is not always the case.

A new study of 1,018 people in the UK by the Fellowship of Professional Willwriters and Probate Practitioners has revealed that more than two thirds of the respondents believed that all willwriters were solicitors. Many solicitors specialise in wills and probate, but it is not the case that all willwriters have a legal background, nor do they require it.

These findings shed further light on the common misconceptions of wills that were recently released by The Fellowship and highlights that consumers need to be aware of this when it comes to having their will drafted.

When asked to respond to the true or false statement that ‘Anyone can currently set themselves up as a willwriter, as qualifications are not needed’, 82% of people thought that was incorrect. In fact, whilst the willwriting industry remains unregulated, anyone can set themselves up in the business of willwriting, regardless of the lack of experience and qualifications they may have or, indeed, their suitability to be entering consumers’ homes offering their services.

45% of people asked said they felt confused by the will writing process and 21% took on the attitude that they would rather write their will themselves, despite the complications that could crop up.

Rita Leat, president of The Fellowship, commented on these findings;

“Here at The Fellowship, we cannot stress enough how important it is for consumers to be aware of exactly who is dealing with their will. There are a lot of excellent willwriters who offer an excellent service; however, we promote the highest standards of practice by ensuring that all our members have nationally accredited qualifications; namely the BTEC qualifications offered by Edexcel.  Consumers should also ask whether the willwriter is a member of professional body that insists on CRB checks and offers a compensation fund should things go wrong.

She continued, “It is quite alarming that the majority of the people we asked thought all willwriters were solicitors, especially as there are many willwriters out there who hold no training or any type of qualification. People need to check the background of the person who is dealing with their will to avoid difficulties for their family and loved ones later.”

Lansing, Michigan — Going through a home foreclosure in Michigan can be very stressful. Often, homeowners want to know how much time they have before they have to more out of their home. It’s true, however, that families are staying in their homes longer due to delays by the mortgage companies in the foreclosure process, although the end result often remains the same. For the average mortgage company, the foreclosure process begins like this:

• If you did not make a mortgage payment on September 1st, a late fee is added on or about September 16th. This affects your credit score and makes it harder to obtain credit or low interest loans.

• Once you are three to four months behind on your house payment, most mortgage companies will demand the full three or four months of payments at once and will not accept any partial payments.

• After four months behind, many mortgage companies begin the foreclosure sale process. A law firm is hired to do the foreclosure paperwork, and attorney fees are added to the late fees and late payments. You will receive letters from this law firm informing you of the foreclosure. They will post your foreclosure proceeding in the local newspaper with a set sale date, often referred to as a sheriff’s sale.

• Mortgage modification programs generally must be agreed to by the mortgage company before the date of the foreclosure sale. Also, if you wish to save your home, a Chapter 13 bankruptcy can do so, but it must be filed before the date of the foreclosure sale to stop the sale from taking place.

• After you are four to five months behind on payments, a foreclosure sale takes place at the county courthouse in the county where the property is located.

• When the foreclosure sale or sheriff’s sale takes place, the homeowner still has a six month right of redemption or a twelve month right of redemption if the mortgage covers a house and approximately four acres of land. During the redemption period, the homeowner may redeem the property or sell it for the full amount owed on the mortgage, plus late fees and attorney fees.

• A Chapter 7 bankruptcy at any time during the foreclosure process discharges the legal obligation to pay any debt incurred associated with the home if you are surrendering the home, but does not affect the six or twelve month redemption period.

• After the six month or twelve month redemption period has expired, if the homeowner is still living in the home, they will receive a 30-day Notice to Quit and be summoned eventually to landlord-tenant court for eviction proceedings, which takes another two to three weeks.

The UK’s only organisation to offer a nationally accredited qualification in will writing and probate practice has revealed the most common misconceptions about wills amongst the British public.

Previous research by the Fellowship of Professional Willwriters and Probate Practitioners found that a high percentage of people aged 18-30 are yet to write a will, with one of the key reasons being a lack of understanding of the law.

So what are the misconceptions?

“My husband will get everything anyway” – This almost always is not the case and people should not assume that their husband, wife or civil partner will automatically get everything if they do not take the time to make a will. The state will decide how much inheritance a surviving spouse will receive under a complex set of rules called the intestacy rules.

“I have nothing to leave” – This may be the case now but things can change. Also a will can set out the appointment of guardians for infant or disabled children, the appointment of executors and trustees and it can set our specific gifts and funeral arrangements.

“My common law wife will get it all” - People often believe that living together automatically makes their partner eligible for inheritance if they should die, but unless it is written in a will this is not so. Surprisingly, according to law, there is no such person as a common law spouse. If you are not married or not in a civil partnership, your partner may have to make a claim through the courts.

“My children will be looked after”- If someone has older children from a previous marriage, they will not necessarily inherit from their parent’s estate, so it is important that they too are included in the will to ensure they will be looked after too.

“My family will sort things out” - Although this is can work well, it is not always recommended as it is a highly stressful job and not always suited to someone who may have been recently bereaved. When writing a will it may be advisable to choose the executor with care.

Siskind Susser Atlanta Immigration Lawyers attorneys Mikiel Davids and Karen Weinstock of the office recently won a landmark case in the U.S. District Court in the Northern District of Georgia against the U.S. Department of Labor. This case is the first in the country of its kind. The court ordered DOL to immediately decide a pending PERM application (foreign labor certification) after finding the agency had unreasonably delayed in doing so. Our attorneys brought the case to federal court in order to ensure that the I-140 immigrant petition for their client could be filed with USCIS before the client’s son turned 21, after which point he would no longer be eligible to obtain a green card with the rest of his family. But the I-140 petition could not be filed until DOL decided the labor certification and the agency refused to expedite a decision on the pending PERM application on the basis of the plaintiff’s son’s “ageing out,” or for any reason, including the fact that the application had been pending 4 months beyond DOL’s stated processing times. To the knowledge of the Plaintiff’s attorneys, the victory secured in this case, Kumykov v. Carlson et al., is the first time that a court has ordered DOL to decide a permanent, foreign labor certification by a court imposed deadline. DOL complied with the court’s Order and approved the labor certification prior to the 21st birthday of the plaintiff’s son, allowing attorneys Karen Weinstock and Mikiel Davids to file the I-140 petition with USCIS in time to preserve the family’s ability to immigrate all together, thus preventing irreparable harm to the applicant and his family.
